Comments on Long-Term Care Facility Staffing Minimums and Reporting Requirements

CMS published a proposed rule that would establish comprehensive staffing requirements for nursing homes. If finalized, nursing facilities would be required to provide a minimum of 0.55 hours of care from a registered nurse per resident per day and 2.45 hours of care from a nurse aide per resident per day. Additionally, all participating nursing homes would need to ensure that a registered nurse is on-site 24 hours per day, 7 days a week. The MLTSS Association provided comments on how this proposed rule could negatively impact the home and community-based services and other healthcare providers while national workforce shortages are ongoing. Instead, we emphasized that CMS needs to consider more comprehensive and collaborative workforce solutions, like those outlined in the MLTSS Association’s Direct Care Workforce Report.
